Roku has to retry multiple times to get MKVs to play

I am having an issue with Rokus (multiple) playing certain videos local and remote. When I start the stream it buffers to 33% a few times resulting in error “playback has stopped due to multiple playback errors”

I have tried the web browser, fire stick, iphone app, and windows app all streaming and able to transcode the same file perfectly. This issue has been ongoing since December. The only way around it is to retry playing the video 3-5 times until it decides to work. I am using GPU transcoding just updated to the latest drivers and it didnt fix it. I have tried reinstalling the player, rebooting server, restarting roku, deleting codecs in server appdata I have made a sample version of the file and retested. The results are that it was okay on direct stream when changing the quality to force transcode it failed to play 4 times and on the fifth retry I was able to get it to play. I will include the sample file below if anyone is interested in replicating the issue.

I am not sure if this issue is client or server side, I will provide logs for both and xml data for offending files.
