The way I’ve overcome is to create a mood called “SMARTRATING-IGNORE” and then add an extra step to the Smart Playlist criteria “Track Rating” is no “SMARTRATING-IGNORE”. This seems to be set at the physical file level and so avoids the issues described above Thanks

So all tracks with duplicated stars I don’t want in my smart playlists get a “SMARTRATING-IGNORE” mood. All my smart playlists also have a “Track Mood is not SMARTRATING-IGNORE” criteria. It works well enough.
