Live TV not tuning

when scanning channels or trying to tune channels I get an error " Could not tune channel. Please check your tuner or antenna" in the log there is an error popping up with every attempt to tune a channel through this device:

it appears that my device is attempting to scann for DVB channels when I set it to scan for ATSC channels and no ammount of tweaking can change that. I am stumped and this is my good tuner in this group so I would really appreciate it if someone knew something about how to fix this issue.

Update: I have built a windows server VM and installed Plex media server on that, That does not have the same behavior. it successfully Scans channels and will tune said channels effectively without further fuss

Update 2: I built a new Plex Media Server docker container and tested it with a brand new install (pointed at an empty config directory) this brand new Plex install in a docker container on unRaid shows the same behavior with my HD Homerun device. This narrows it down to the Linux (docker) Build of PMS anyone have any ideas?
