Ipad subtitles on downloads not always playing

When I download shows to my iPad with subtitles selected, they play fine when I play them from the “Downloads” section. When I play the same show from “Home” or from my “TV shows” library the subtitles will not play. They do show up on the title page of the episode, but they do not play and are not available under the “playback settings” section. Thoughts?

It’s sad that it seems other users have been complaining about this for a while, but there has been no fix issued.
