I won't say that i've never been silly enough not to check that first, but this time I did do so and they are not burned in.

I'm not entirely sure what you are asking me here. If you mean to make sure that the ATV setting are not playing the subtitles in Setting > Audio & Video both Subtitle Language and Closed Captioning are set to Off.
I see the same problem on some videos; I disable subtitles but they still appear (this is rather annoying when the subtitle is out of sync).
PS. If subtitle sync +/- is technically possible with PlexConnect that would be a very cool feature to have implemented at some point :)
Also still having no subs on mp4 movie of series. Works on other players but not atv3 plexconnect. So ok for english users but the rest of us…

I have the same issue. Sometimes they canbe disabled and sometimes they keep showing even if disabled.
I also had the problem a few times the other way round: Subtitles not showing even though enabled and showing fine in Plex Web.
It feels like that it remembers the first time you (de)select the subtitles that it will persist for all the next plays. If I change the subtitles after I have started playing an item, it still uses the subtitles selected upon the first play.
I have also had this issue. Only with some files strangely. Nothing I've tried disables them. I'm thinking I'll need to rename the SRT folder as it's pretty annoying.
I don't have this issue with other Plex clients so I think it's a Plex or ATV issue.

Yes, I had subtitle enabled before first playback of an item and then turned it off after starting playback for a while, but the subtitle still showed.
On a different movie, I had subtitle disabled and then after starting it I went back and turned the subtitle on, but it would not show up.
I didn't try restarting from the beginning though to see if that would fix it.
Hey guys, apologies but I have been tied up recently with buying a new house (mainly the ‘joys’ if dealing with multiple sets if lawyers).
I will try and get to this tonight and see if I can figure out what is going on.

There might be an identification issue with our client at the PMS. We will have another look... Stay tuned.
Just to clarify ~ if you're playing an MP4 file, it's likely this is just passed directly to the ATV player. I'm not sure what it does with subtitles.
If you're playing an MKV file with subs disabled and the subs are still showing, something is weird. If you can paste the relevant snippet from the Plex Media Server.log file, we can see what's happening.
You might also want to check what the Apple settings for subs are on your ATV.
